It is expressly understood and agreed between the parties that:
- The lessee (You) agrees to pay for all damage to the bicycle(s) and or equipment during the hire period and agrees to pay all repair or replacement cost.
- The lessee agrees that they are fully responsible for all losses if the bicycles(s) and or equipment is/ are lost, stolen or destroyed. In the event of such occurrences charges are set at the time by any staff or management of Sunreef Mooloolaba.
- I name and acknowledge the full responsibility for participants less than 18 years of age
- If applicable upon returning the hired equipment if staff or management of Sunreef Mooloolaba deem fit an additional cleaning fee of $25 may be charged or an additional cleaning fee of $95 is applicable if ridden on the beach or if there are signs of the bicycle(s) being ridden on the beach.
- When leaving the bicycle unattended it must be secured with the lock provided through the frame of the bike to an immovable object. In the event of the lessor (Sunreef Mooloolaba) being called out due to key loss a $35 fee will be charged.
- If the lessee loses the lock a fee of $25 is applicable
- All riders must wear an approved helmet which is provided by the lessor or their own approved helmet.
- The lessee must inspect the bicycle and associated equipment prior to the completion of the rental agreement, the lessee confirms that the bicycle(s) is in a good roadworthy condition and has no damage or defects whatsoever.
- Night cycling is not permitted as the bicycles are not fitted with lights.
- Bikes not returned at the specified time will be charged an extra hour rental charge.
- The lessee agrees that the bicycle(s) will not be ridden by anyone except for the people named in the form.
- The lessee agrees that participant(s) will comply with all road rules at all times.
- The lessee will notify Sunreef Mooloolaba immediately of any accident or damage.
- The lessee acknowledges that renting a bicycle entails unknown risks that could result in injury or damage to participants, property or third parties and the lessee accepts that such risks cannot be eliminated without jeopardizing the essential qualities of the activities. The risks include among other things: accidents involving other vehicles or bicycles, collision with fixed or moveable objects, falls from the bicycle, the negligence of other operators of motor vehicles or the participant, weather conditions, the participants own physical conditions, the condition of roads, terrain or highways and accidents connected with their use, contact with animals or insects.
- The lessee hereby releases and forever discharges and indemnifies and agrees to indemnify and hold harmless Sunreef Mooloolaba, their agents, owners, officers, volunteers, participants and employees against any and all claims, demands and causes of action which are in any way connected with participation in this activity or use of Sunreef Mooloolaba equipment or facilities. Such release may be pleaded as a complete defence to any claim, demand or cause of action brought by the lessee, a participant or anyone claiming through the lessee against Sunreef Mooloolaba.
- Any breach of this agreement by the lessee and or participant(s) gives Sunreef Mooloolaba the right to terminate this agreement and to immediately repossess the bicycle(s) and accessories.
Road Rules
- As a bicycle rider you are riding a ‘legal’ vehicle. You have the same rights and responsibilities as any other vehicle on the road. As such you are required to obey the road rules, including stopping at red lights or stop signs, giving way as indicated by signage and giving hand signals when changing direction.
- Key Road rules that apply to cyclists include but are not limited to:
- All cyclists are required by law to wear an approved helmet. The Police will fine cyclists who ride without an approved helmet
- Cyclists can ride in bus, transit and bicycle lanes.
- In Queensland cyclists can ride on footpaths unless prohibited by a sign, but must keep left and give way to pedestrians.
- Cyclists can ride 2 abreast, but must remain within 1.5m of each other
- While riding on roads, cyclist are required to use bike lanes where provided unless impractical to do so
- You must obey all traffic lights
You are responsible for and agree to the following:
- The hirer (You) will use the boat in a responsible manner having regards for their passengers, other boat users, swimmers and the equipment.
- To carry no more than the agreed number of passengers.
- Boats are restricted to the Mooloolah River and are specifically NOT permitted to enter the ocean.
- All passengers must ride inside the boat, bow riding is illegal.
- Boats must stay 30 meters away from all other vessels, swimmers and obstructions.
- Prior to departure you will be giver instructions on how to properly navigate, operate the outboard, how to use equipment and how to handle the boat.
- It is the hirers responsibility to obtain all navigational rules and regulations before departure.
- The hirer agrees to leave a valid credit card or cash bond
- The hirer agrees to pay for all damages, infringements and late return penalties
- I name and acknowledge the full responsibility for participants less than 18 years of age
- I hereby acknowledge that I have read and understood and agree to this disclaimer of liability.

I release, indemnify and hold harmless the service Provider (Sunreef Hire), its servants and agents, from and against any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.

I further acknowledge that Sunreef Diving will give no refunds for seasickness, inability to equalize or for any other reason that prevents an individual from participating fully.
- I have no medical condition that would affect my ability to safely dive and I am not taking any medication that has not been approved by my physician for diving. I am not currently under the effect of alcohol or drugs.
- I will not fly within 24hrs from surfacing after my last dive.
- I warrant that as a certified diver my skill levels are at least equal to a newly certified open water diver. I understand that dive guides supplied by Sunreef are solely to enhance my diving experience and not because such guidance is required to compensate for my lack of diving skill.
- Sunreef may cancel or change trip destinations at any time due to weather or any other unforeseen circumstances.
- Sunreef may change the time of my trip due to weather or any other unforseen circumstances.
- If you wish to change your booking in any way, it must be done at least 72hrs prior to the planned start time of your trip. Changes made with in the 72hrs will incur a charge of $99.
- I will follow the direction of Sunreef staff at all times to ensure a safe and fluid operation. I will listen to all briefings and seek advice if I don't understand any part of the brief.
- I take the responsibility for checking the safe and correct operation of my dive equipment prior to diving whether the equipment be provided by myself or Sunreef Hire Gear. I will carry and know how to use the following:- safety sausage, whistle, snorkel, torch and dive computer.
- I take responsibility for the planning of my dive and then diving my plan within a safe NO DECOMPRESSION DIVE.
- I understand that both dives on the selected reef site will be guided. Dives into overhead environments are not to be undertaken if the sea conditions, visibility or diver ability are not seen adequate by Sunreef Employees.
- The dives are planned as 50 minute Dives.
- I will return to the vessel with a minimum of 50bar remaining in my cylinder, failure to do so may result in cancellation of my second dive or refusal for future bookings.
By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. I am fully aware of the contents of this form and have clearly read and understood all the above points. This document is valid for 12 months from date of submission. Hire Terms and Conditions
- All Sunreef equipment will be left on board the vessel I am travelling in the condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent diver and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Tanks being hired are to be checked to ensure they have a fill pressure of at least 200 Bar.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable, including unused air.
- Please note that no refund will be issued for any dives not completed.
The following policies must be followed at all times.
- You must follow the direction of the session Supervisor at ALL times
- NO WAVE JUMPING the hire will be stopped immediately without a refund
- At all times you must stay a minimum of 300 meters away from the beach
- At all times you must stay a minimum of 100 meters away from all other jet ski hirers, all other watercraft, swimmers, paddlers ETC.
- At all times you must stay within designated hire area and keep visual contact on the rescue vessel
- No rider under the age of 16 or that has not completed the practical assessment may drive the Jet Ski
- Whilst riding through the Mooloolah River you must navigate in single file 20 meters apart from each other and the rescue vessel and adhere to the maximum 6 knot no wash limit, this limit also applies on return from the hire to the river
- When riding the jet ski ensure you can see all other water users it is your responsibility to stay clear and give way to others
- Whilst on your jet ski you must wear your life jacket at all times
- When the rescue vessel signals the end of you hire you must return to the rendezvous point
- If you have any medical conditions that may affect or be affected by riding a hired jet ski, please specify to the staff member prior to departure
- 0 (Zero) blood alcohol level is required to participate in any and all hire activities
At all times we are observing you. If you have any difficulty or feel unsafe return to the rescue boat or wave your arms to attract attention. Wait on your ski if safe to do so, otherwise abandon your jet ski; your life jacket will keep you afloat at all times. If you are in a collision report to the rescue vessel immediately. You are deemed responsible for your own safety, the safety of others and the care of your hired jet ski, as such, you ride at your own risk and you are responsible and will be held accountable for any damage and or injury caused wilfully or negligently. Further costs can and may be brought against you. The owners, management and staff of Sunreef Hire reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.
I ACKNOWLEDGE AND UNDERSTAND THAT WHILST PARTICIPATING IN THE ACTIVITY:
- The conditions in which the activity is conducted may vary without warning.
- Other persons participating in the activity may cause me injury or damage to my property for which they may be liable.
- I may cause injury to other persons or damage their property, for which I may be liable.
- I may cause loss of damage to property used/hired for which I would be liable.
- I may be injured/ inflict damage to my property as a result of my negligence or breach of contract.
- There may be no or inadequate facilities for treatment or transport of me if I am injured.
- I assume the risk of and responsibility for any injury, death or property damage resulting from my participation.
- I will take special attention to all instructions oral or written and will query any matters that I do not understand.
- I am not under the influence of drugs/medication/mind altering substances that affect my understanding of safety instructions or ability to safely participate.
- I do not have any allergies that affect my ability to participate any aspect of this activity
- I do not suffer from any mental infirmity/allergies that may prejudice my performance/safety or the safety of others.

- I take the responsibility for checking the safe and correct operation of my dive equipment prior to diving whether the equipment be provided by myself or Sunreef Hire Gear. I will carry and know how to use the following:- safety sausage, whistle, snorkel and dive computer.
- I take responsibility for the planning of my dive and then diving my plan within a safe NO DECOMPRESSION DIVE.
- The dives are planned as 50 minute Dives provided your air lasts that period of time.
- I will return to the vessel with a minimum of 50bar remaining in my cylinder, failure to do so may result in cancellation of my second dive or refusal for future bookings.
- By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. I am fully aware of the contents of this form and have clearly read and understood all the above points. This document is valid for 12 months from date of submission.
Hire Terms and Conditions
- All Sunreef equipment will be left on board the vessel I am travelling in the condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent diver and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Tanks being hired are to be checked to ensure they have a fill pressure of at least 200 Bar.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable, including unused air.

The following policies must be followed at all times.
- You must follow the direction of the session Supervisor at ALL times
- NO WAVE JUMPING the hire will be stopped immediately without a refund
- At all times you must stay a minimum of 300 meters away from the beach
- At all times you must stay a minimum of 100 meters away from all other jet ski hirers, all other watercraft, swimmers, paddlers ETC.
- At all times you must stay within designated hire area and keep visual contact on the rescue vessel
- No rider under the age of 16 or that has not completed the practical assessment may drive the Jet Ski
- Whilst riding through the Mooloolah River you must navigate in single file 20 meters apart from each other and the rescue vessel and adhere to the maximum 6 knot no wash limit, this limit also applies on return from the hire to the river
- When riding the jet ski ensure you can see all other water users it is your responsibility to stay clear and give way to others
- Whilst on your jet ski you must wear your life jacket at all times
- When the rescue vessel signals the end of you hire you must return to the rendezvous point
- If you have any medical conditions that may affect or be affected by riding a hired jet ski, please specify to the staff member prior to departure
- 0 (Zero) blood alcohol level is required to participate in any and all hire activities
At all times we are observing you. If you have any difficulty or feel unsafe return to the rescue boat or wave your arms to attract attention. Wait on your ski if safe to do so, otherwise abandon your jet ski; your life jacket will keep you afloat at all times. If you are in a collision report to the rescue vessel immediately. You are deemed responsible for your own safety, the safety of others and the care of your hired jet ski, as such, you ride at your own risk and you are responsible and will be held accountable for any damage and or injury caused wilfully or negligently. Further costs can and may be brought against you. The owners, management and staff of Sunreef Hire reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.
I ACKNOWLEDGE AND UNDERSTAND THAT WHILST PARTICIPATING IN THE ACTIVITY:
- The conditions in which the activity is conducted may vary without warning.
- Other persons participating in the activity may cause me injury or damage to my property for which they may be liable.
- I may cause injury to other persons or damage their property, for which I may be liable.
- I may cause loss of damage to property used/hired for which I would be liable.

- There may be no or inadequate facilities for treatment or transport of me if I am injured.

- I am not under the influence of drugs/medication/mind altering substances that affect my understanding of safety instructions or ability to safely participate.
- I do not have any allergies that affect my ability to participate any aspect of this activity
- I do not suffer from any mental infirmity/allergies that may prejudice my performance/safety or the safety of others.
- I name and acknowledge the full responsibility for participants less than 18 years of age.
Release and indemnity to the service provider:
In consideration of the acceptance of me participating, except to the extent it is precluded by statutory law I AGREE TO RELEASE AND INDEMNIFY the service provider as follows:
I release, indemnify and hold harmless the service provider, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.

- At all times you must stay within the designated hire area (Mooloolah River and Canals only)
- If you are over the age of 12 and are able to swim you are not required to wear a lifejacket. However, lifejackets are issued free of charge to any participant and if required must be worn at all times.
- 0 (Zero) alcohol tolerance level is required of all participants.
- You MUST report any incident or collision that has occurred during your hire.
- You are responsible for any participants under 18 years of age
- Only people named by you on this form are allowed to use the hired equipment
- You must pay for any broken or lost paddles/ seats or kayaks
- You are deemed responsible for your own safety and the safety of others, as such, you participate at your own risk and you will be held responsible for injury caused wilfully or by negligence on your part.
- You are deemed responsible for the care of the equipment you hire, as such, you are accountable for any damage and understand further costs can be bought against you
- You acknowledge that you are solely responsible for obtaining all advice and information necessary for the safety and the safe use of the stand-up paddle equipment.
- The owners, management and staff of Hire Hut Mooloolaba reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.

Terms and Conditions
I am aware that skin diving has inherent risks which may result in serious injury or death. I understand and agree that neither my guide(s)/instructor(s), nor the facility through which this program is offered, Sunreef, nor PADI Americas, Inc., nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”), may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this program or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to participate in this program, I hereby personally assume all risks of this program whether foreseen or unforeseen, that may befall me while I am participating in this program. I further release, exempt and hold harmless said program and Released Parties from any claim or lawsuit by me, my family, estate, heirs or assigns, arising out of my enrollment and participation in this program. I understand that snorkeling and skin diving are physically strenuous activities and that I will be exerting myself during this program, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same. I understand that past or present medical conditions may be contraindicative to my participation in the program. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have a history of seizures, dizziness or fainting, or a history of heart condition (e.g. cardiovascular disease, angina, heart attack). I further affirm that I do not have a history of respiratory problems such as emphysema or tuberculosis. I affirm that I am not currently taking medication that carries a warning about any impairment of my physical or mental abilities. I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. It is expressly understood and agreed between the parties that:
- The lessee (You) agrees to pay for all damage to the bicycle(s) and or equipment during the hire period and agrees to pay all repair or replacement cost.
- The lessee agrees that they are fully responsible for all losses if the bicycles(s) and or equipment is/ are lost, stolen or destroyed. In the event of such occurrences charges are set at the time by any staff or management of Sunreef Mooloolaba.
- I name and acknowledge the full responsibility for participants less than 18 years of age
- If applicable upon returning the hired equipment if staff or management of Sunreef Mooloolaba deem fit an additional cleaning fee of $25 may be charged or an additional cleaning fee of $95 is applicable if ridden on the beach or if there are signs of the bicycle(s) being ridden on the beach.
- When leaving the bicycle unattended it must be secured with the lock provided through the frame of the bike to an immovable object. In the event of the lessor (Sunreef Mooloolaba) being called out due to key loss a $35 fee will be charged.
- If the lessee loses the lock a fee of $25 is applicable
- All riders must wear an approved helmet which is provided by the lessor or their own approved helmet.
- The lessee must inspect the bicycle and associated equipment prior to the completion of the rental agreement, the lessee confirms that the bicycle(s) is in a good roadworthy condition and has no damage or defects whatsoever.
- Night cycling is not permitted as the bicycles are not fitted with lights.
- Bikes not returned at the specified time will be charged an extra hour rental charge.
- The lessee agrees that the bicycle(s) will not be ridden by anyone except for the people named in the form.
- The lessee agrees that participant(s) will comply with all road rules at all times.
- The lessee will notify Sunreef Mooloolaba immediately of any accident or damage.
- The lessee acknowledges that renting a bicycle entails unknown risks that could result in injury or damage to participants, property or third parties and the lessee accepts that such risks cannot be eliminated without jeopardizing the essential qualities of the activities. The risks include among other things: accidents involving other vehicles or bicycles, collision with fixed or moveable objects, falls from the bicycle, the negligence of other operators of motor vehicles or the participant, weather conditions, the participants own physical conditions, the condition of roads, terrain or highways and accidents connected with their use, contact with animals or insects.
- The lessee hereby releases and forever discharges and indemnifies and agrees to indemnify and hold harmless Sunreef Mooloolaba, their agents, owners, officers, volunteers, participants and employees against any and all claims, demands and causes of action which are in any way connected with participation in this activity or use of Sunreef Mooloolaba equipment or facilities. Such release may be pleaded as a complete defence to any claim, demand or cause of action brought by the lessee, a participant or anyone claiming through the lessee against Sunreef Mooloolaba.
- Any breach of this agreement by the lessee and or participant(s) gives Sunreef Mooloolaba the right to terminate this agreement and to immediately repossess the bicycle(s) and accessories.
Road Rules
- As a bicycle rider you are riding a ‘legal’ vehicle. You have the same rights and responsibilities as any other vehicle on the road. As such you are required to obey the road rules, including stopping at red lights or stop signs, giving way as indicated by signage and giving hand signals when changing direction.
- Key Road rules that apply to cyclists include but are not limited to:
- All cyclists are required by law to wear an approved helmet. The Police will fine cyclists who ride without an approved helmet
- Cyclists can ride in bus, transit and bicycle lanes.
- In Queensland cyclists can ride on footpaths unless prohibited by a sign, but must keep left and give way to pedestrians.
- Cyclists can ride 2 abreast, but must remain within 1.5m of each other
- While riding on roads, cyclist are required to use bike lanes where provided unless impractical to do so
- You must obey all traffic lights

- Only people named by you on this form are allowed to use the hired equipment
- You must pay for any broken or lost paddles/ seats or kayaks
- You are deemed responsible for your own safety and the safety of others, as such, you participate at your own risk and you will be held responsible for injury caused wilfully or by negligence on your part.
- You are deemed responsible for the care of the equipment you hire, as such, you are accountable for any damage and understand further costs can be bought against you
- You acknowledge that you are solely responsible for obtaining all advice and information necessary for the safety and the safe use of the stand-up paddle equipment.
- The owners, management and staff of Hire Hut Mooloolaba reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.
I ACKNOWLEDGE AND UNDERSTAND THAT WHILST PARTICIPATING IN THE ACTIVITY:
- The conditions in which the activity is conducted may vary without warning.
- Other persons participating in the activity may cause me injury or damage to my property for which they may be liable.
- I may cause injury to other persons or damage their property, for which I may be liable.

I release, indemnify and hold harmless the service provider, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.

The following policies must be followed at all times.
- You must follow the direction of the session Supervisor at ALL times
- NO WAVE JUMPING the hire will be stopped immediately without a refund
- At all times you must stay a minimum of 300 meters away from the beach
- At all times you must stay a minimum of 100 meters away from all other jet ski hirers, all other watercraft, swimmers, paddlers ETC.
- At all times you must stay within designated hire area and keep visual contact on the rescue vessel
- No rider under the age of 16 or that has not completed the practical assessment may drive the Jet Ski
- Whilst riding through the Mooloolah River you must navigate in single file 20 meters apart from each other and the rescue vessel and adhere to the maximum 6 knot no wash limit, this limit also applies on return from the hire to the river
- When riding the jet ski ensure you can see all other water users it is your responsibility to stay clear and give way to others
- Whilst on your jet ski you must wear your life jacket at all times
- When the rescue vessel signals the end of you hire you must return to the rendezvous point
- If you have any medical conditions that may affect or be affected by riding a hired jet ski, please specify to the staff member prior to departure
- 0 (Zero) blood alcohol level is required to participate in any and all hire activities
At all times we are observing you. If you have any difficulty or feel unsafe return to the rescue boat or wave your arms to attract attention. Wait on your ski if safe to do so, otherwise abandon your jet ski; your life jacket will keep you afloat at all times. If you are in a collision report to the rescue vessel immediately. You are deemed responsible for your own safety, the safety of others and the care of your hired jet ski, as such, you ride at your own risk and you are responsible and will be held accountable for any damage and or injury caused wilfully or negligently. Further costs can and may be brought against you. The owners, management and staff of Sunreef Hire reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.

BOOKINGS
Upon booking the Charterer acknowledges all Terms and Conditions. Your booking is considered confirmed when the deposit is received.
Final number of guests, cruise times, catering selections, entertainment requirements and balance of payment are all to be finalised within fourteen (14) business days prior to the event date. Additions to the final numbers may be accepted up to five (5) days prior to the event date, must be paid for in full at the time of notification. No refunds will be distributed if actual numbers of guests are lower than the final numbers given at time of payment.
PAYMENTS
A 50% deposit payment is required within 5 working days of receiving a Booking Form from Whale One, to secure your booking. If a deposit payment is not received within the given period, the company reserves the right to allocate the vessel to another client. The vessel hirer is required to sign the Booking Form, specifying cruise details and conditions and return with your holding deposit.
Special arrangements may be made when discussing the conditions with our Booking Office Team. All charter quotes are in Australian Dollars (AUD) and will indicate the cost of the various charter components, including the cruising tariff, catering, beverages and entertainment, where applicable. Australian Goods and Services Tax (GST) will be applied to the sub-total of all the cost components and the total quote will include GST.
No refund is given if the actual number of guests is less than the minimum guaranteed passengers or the final number of guests advised to us by vessel hirer 5 days prior to the function.
Payments are accepted through Electronic Bank Transfer or credit card (Visa and Mastercard). Full payment to be made fourteen (14) business days prior to event date.
SECURITY AND CLEANING DEPOSIT
Along with the above, A deposit of $500 for your charter is taken to cover any damages or excessive cleaning costs caused by your guests throughout your time aboard the vessel. Any damage will be repaired by a licensed contractor and will be charged to you at their rates. A copy of the invoice will be provided to you. Any remaining balance of the $500 will be refunded to you within 72 hrs of completion of work. If no damage is caused, the full amount will be refunded to you within 72 hours.
Sunreef Mooloolaba accepts no responsibility for loss or damage to goods brought on board and/or left on the vessel, before, during or after the event.
CANCELLATION POLICY
More than 30 days prior to event date: Deposit will be refunded.
Between 30 – 14 days prior to event date: Loss of deposit.
Less than 14 days prior to event date: Loss of deposit plus $200 cancellation fee.
If a Charterer requests less than 30 days prior to a booked trip that the trip is rescheduled to another date, Sunreef may at its discretion agree to reschedule the trip and to credit any Deposit paid by the Charterer against the cost of the rescheduled trip. However, the Charterer acknowledges and agrees that if Sunreef agrees to credit the Deposit to the rescheduled trip, the Deposit will be non-refundable and the Charterer will not be entitled to any refund if the Charterer cancels the rescheduled trip at any time prior to the date of the trip.
Sunreef reserves the right at any time to cancel any cruise. If, in the opinion of the skipper, the voyage cannot be continued for any reason, then the skipper may terminate the cruise at any time.
Sunreef is not a common carrier and reserves the right to refuse to carry any passenger, baggage or goods without assigning any reason. Therefore passengers shall comply with the Navigation Act 1912 (as amended 1079) and all regulations, orders or instructions given by the skipper.
Sunreef reserves the right to amend vessels, menu, entertainment or any other aspect of your Private Charter where necessary and without notice. Private Charters may be cancelled or have schedule changes (with or without notice) for a variety of reasons, including, but not limited to bad weather condition and technical disruptions. We will not be responsible for paying costs or expenses you may incur as a result of change of time or cancellation.
Although it us highly unlikely in the river, if you or any of your guests find yourselves dealing with seasickness, our crew will look after you and ensure you are comfortable and safe. However, as this is not something in our control, we will not issue any rebookings or refunds for being seasick.
BOARDING TIME
The boarding period usually takes 30 minutes, and you will be greeted by a staff member who will take your boarding pass and welcome you to the boat. You are required to send a completed list of names of the persons coming on board for your charter as soon as possible prior to the date of your charter. Delays in our cruise departure for any late arrivals or adjustments to the list of passengers will be taken off of the total cruise time. Please ensure you and your guests allow enough time for travel and parking at Mooloolaba Wharf.
Guests must check in to Sunreef Mooloolaba before boarding to receive a boarding pass.
NO-SHOWS
Failure to turn up for your Private Charter on the agreed date attracts a 100% cancellation fee. NO REFUNDS.
DURATION OF THE CHARTER
Embarkation and disembarkation take place at the Mooloolaba Wharf, 123 Parkyn Parade. The duration of the Charter includes the time taken to embark and disembark guests of the Charterer’s group.
Sunreef is not responsible for any delays caused by the late arrival of guests of the Charterer’s group or delays at the wharf caused by crowds, the arrival of other vessels or any other item beyond the vessel’s control. If disembarking guests takes longer than 20 minutes beyond the scheduled end of the Charter, the Charterer will be charged for this time pro rata (30 minutes extension) to the vessel hire rate.
SUITABILITY OF THE VESSEL
It is the responsibility of the Charterer to inspect the vessel prior to the Charter to determine the vessel’s suitability. The Charterer represents and warrants to Sunreef that the Charterer is satisfied with the vessel and the standard of services offered by Sunreef to be provided in respect of the Charter.
DECORATIONS
All decorations and/or additional set up prior to departure must be prearranged. Decorations must be placed so no damage results to the vessel; no pins or adhesive tape. No confetti and balloons are discouraged.
THE SKIPPER AND SUNREEF MANAGEMENT
The Skipper (Master) has total discretion as to the operation of the vessel including passenger loading, vessel route, event timing, carriage of goods, serving of alcohol, acceptable conduct of passengers, and the disembarkation of any ill-behaved guests.
In the event of a passenger being required not to embark or to disembark from the vessel under the provisions of this condition, Sunreef, nor the skipper shall be under any liability to such passenger of any kind whatsoever.
The Skipper and Sunreef shall not be responsible for any injury to person or damage to property arising out of any cruise.
Sunreef shall not be responsible for any damage or loss occasioned.
RESPONSIBLE SERVICE OF ALCOHOL
If you expect to be served alcohol we will require a valid photo ID prior to boarding. A photo image of ID is not permitted. Alcohol may not be carried from the vessel on disembarkation.
Whale One is a licensed venue and does not allow BYO. Staff reserve the right to refuse entry onto the vessel, the service/supply of alcohol to any unduly intoxicated, underage or disorderly guests.
If deemed necessary, the Skipper may elect to dock the vessel and remove the guest and notify police. Rowdy or unruly behaviour will not be tolerated. The Operator and the vessel have a “Responsible Service of Alcohol Policy” that applies during the Charter. If behaviour falls outside the guidelines of this policy then Sunreef may, in conjunction with the Skipper, do any of the following:
- Terminate the Charter by berthing the vessel at the nearest safe location and disembarking the passengers.
- Summon the Police to remove offending passengers
- Negotiate with the Charterer to agree on some other course of action to resolve the issue.
Any costs associated with the early termination of the Charter due to unruly or rowdy behaviour must be paid by the Charterer.
NOT PERMITTED
There is strictly NO SMOKING on board any of our vessels.
Passengers shall not carry any alcoholic liquor, matches (other than safety matches), explosives, volatile spirit or other goods of a dangerous, inflammable or offensive nature.
DRESS CODE
Dress appropriate for the weather; there are open air, protected and enclosed areas available, but no air conditioning. Due to safety regulations, the footwear dress code exclusions are as follows:
No thongs/flip flops
No stiletto heels
GUEST BEHAVIOUR
Good behaviour is expected. Any passengers doing the following will be reported to the Australian Maritime Safety Authority (AMSA) and/or Queensland Police Service (QPS):
- Use of illegal drugs
- Swinging from the handrails
- Jumping off the vessel
- Urinating off the side of the vessel
- Throwing debris from the vessel
- Yelling at patrons on docks and houses
- Fighting or aggressive arguments
Actions of this sort may be recorded as a Marine Incident with persons liable for on the spot or delayed fines of up to $2200.
SAFETY AND SECURITY
Our vessels are equipped to safely carry passengers. Please listen closely to the safety briefing prior to departure. If you have any questions, ask a crew member. All passengers are carried at their own risk, Sunreef does not accept responsibility or liability for any injury suffered whilst boarding, aboard, or disembarking from its vessel. Operation of the vessel and any of its equipment is restricted to the Skipper and Crew of Sunreef.
Skipper: The Skipper (Master) has total discretion as to the operation of the vessel including passenger loading, vessel route, event timing, carriage of goods, serving of alcohol, acceptable conduct of passengers, and the disembarkation of any ill-behaved guests.
Security may be on board. The vessel is monitored by CCTV. Security will enforce all listed terms and conditions and reserve the right refuse entry or to remove unruly guest from the vessel. Illegal actions will incur Queensland Police attention.
DISABILITY AND MOBILITY
Unfortunately, due to vessel construction, Sunreef vessels are not wheelchair accessible.
PRAMS
Pram space may be limited. Please advise us upon booking regarding the need for pram space.
CHARTER COURSE
The course to be undertaken during the Charter may be agreed in advance with Sunreef or with the Skipper. Sunreef reserves the right, at its sole discretion or that of the Skipper, to vary the agreed course because of weather, wave height, traffic, vessel survey restrictions, or any other cause which Sunreef or the Skipper believes is justified in the interests of the comfort or safety of passengers, crew, the vessel and other vessels.
SUBSTITUTION OF VESSEL
Sunreef may substitute another vessel for the specified vessel in the case of any unforeseen circumstances (including mechanical breakdown). In such cases, Sunreef has no liability to the Charterer for such substitution provided that the substituted vessel satisfactorily meets the Charter particulars and provides the level of services as originally agreed.
LIMIT OF LIABILITY
To the extent permissible by law, Sunreef Mooloolaba is not responsible in sort, contract or otherwise for any loss or damage arising out of injury or death sustained by the Charterer or any guest of the Charterer’s group, howsoever arising and whether arising as a result of the Operator’s negligence or failure to render due care.
The Charterer enters into this Charter Agreement at its own risk.
If, however any guarantees, terms, conditions or warranties are implied into this Charter Agreement by any law of the Commonwealth of Queensland, the exclusion of which would contravene that law or cause part or all this clause to be void, then to the extent permissible by law.
The law of Queensland governs this agreement and the parties agree to submit to the jurisdiction of the courts of Queensland in respect of any dispute arising between them. Sunreef Mooloolaba has no liability for failing to perform its obligation under this terms and conditions due to any industrial action, unsuitable weather conditions, mechanical or technical breakdowns or other events beyond its reasonable control.
The Charterer agrees to indemnity and hold Sunreef Mooloolaba harmless, it’s agents and employees from and against any and all losses, claims, actions, expenses, fees, damages, fines and liabilities (including reasonable legal fees) arising from the Charter or caused by any negligent act or omission by the Charterer or guests of the Charterer’s group.
INDEMNITY
The Charterer agrees to indemnify and hold harmless Sunreef, its agents and employees, from and against any and all losses, claims, actions, costs expenses, fees, damages, fines and liabilities (including reasonable legal fees) arising from the Charter or caused by any negligent act or omission by the Charterer or members of the Charterer’s group.
FORCE MAJURE
Sunreef has no liability for failing to perform its obligations under this terms and conditions due to any industrial action, unsuitable weather conditions, mechanical or technical breakdowns or other events beyond Sunreef’s reasonable control.
PARKING
The Wharf complex has limited timed parking before 6pm. Please allow 15-20mins prior to your boarding time to find appropriate parking.
YOUR PRIVACY
At Sunreef, we are committed to protecting your privacy. We use the information we collect about you to maximize the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adheres to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.
You may change your details at any time by advising us in writing via email. All information we receive from our customers, is protected by our secure servers. whaleone.com.au’s secure server software encrypts all customer information before it is sent to us. Furthermore, all of the customer data whaleone.com.au collects are secured against unauthorised use or access. Credit card information is not stored by us on our servers.
THIRD PARTIES
Sunreef does not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve its website and its services but not for any other use.
DISCLOSE YOUR INFORMATION
Sunreef may be required, in certain circumstances, to disclose information in good faith and where Sunreef is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
EXCLUSION OF COMPETITORS
If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of Sunreef. Sunreef expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party.
If you breach this term, then Sunreef will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. whaleone.com.au reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.
JURISDICTION
This agreement and this website are subject to the laws of Queensland and Australia. If there is a dispute between you and Sunreef that results in litigation, then you must submit to the jurisdiction of the courts of Queensland.

More than 30 days prior to event date: Deposit will be refunded.
Between 30 – 14 days prior to event date: Loss of deposit.
Less than 14 days prior to event date: Loss of deposit plus $200 cancellation fee.
If a Charterer requests less than 30 days prior to a booked trip that the trip is rescheduled to another date, Sunreef may at its discretion agree to reschedule the trip and to credit any Deposit paid by the Charterer against the cost of the rescheduled trip. However, the Charterer acknowledges and agrees that if Sunreef agrees to credit the Deposit to the rescheduled trip, the Deposit will be non-refundable and the Charterer will not be entitled to any refund if the Charterer cancels the rescheduled trip at any time prior to the date of the trip.
Sunreef reserves the right at any time to cancel any cruise. If, in the opinion of the skipper, the voyage cannot be continued for any reason, then the skipper may terminate the cruise at any time.
Sunreef is not a common carrier and reserves the right to refuse to carry any passenger, baggage or goods without assigning any reason. Therefore passengers shall comply with the Navigation Act 1912 (as amended 1079) and all regulations, orders or instructions given by the skipper.
Sunreef reserves the right to amend vessels, menu, entertainment or any other aspect of your Private Charter where necessary and without notice. Private Charters may be cancelled or have schedule changes (with or without notice) for a variety of reasons, including, but not limited to bad weather condition and technical disruptions. We will not be responsible for paying costs or expenses you may incur as a result of change of time or cancellation.
Although it us highly unlikely in the river, if you or any of your guests find yourselves dealing with seasickness, our crew will look after you and ensure you are comfortable and safe. However, as this is not something in our control, we will not issue any rebookings or refunds for being seasick.
BOARDING TIME
The boarding period usually takes 30 minutes, and you will be greeted by a staff member who will take your boarding pass and welcome you to the boat. You are required to send a completed list of names of the persons coming on board for your charter as soon as possible prior to the date of your charter. Delays in our cruise departure for any late arrivals or adjustments to the list of passengers will be taken off of the total cruise time. Please ensure you and your guests allow enough time for travel and parking at Mooloolaba Wharf.
Guests must check in to Sunreef Mooloolaba before boarding to receive a boarding pass.
NO-SHOWS
Failure to turn up for your Private Charter on the agreed date attracts a 100% cancellation fee. NO REFUNDS.
DURATION OF THE CHARTER
Embarkation and disembarkation take place at the Mooloolaba Wharf, 123 Parkyn Parade. The duration of the Charter includes the time taken to embark and disembark guests of the Charterer’s group.
Sunreef is not responsible for any delays caused by the late arrival of guests of the Charterer’s group or delays at the wharf caused by crowds, the arrival of other vessels or any other item beyond the vessel’s control. If disembarking guests takes longer than 20 minutes beyond the scheduled end of the Charter, the Charterer will be charged for this time pro rata (30 minutes extension) to the vessel hire rate.
SUITABILITY OF THE VESSEL
It is the responsibility of the Charterer to inspect the vessel prior to the Charter to determine the vessel’s suitability. The Charterer represents and warrants to Sunreef that the Charterer is satisfied with the vessel and the standard of services offered by Sunreef to be provided in respect of the Charter.
DECORATIONS
All decorations and/or additional set up prior to departure must be prearranged. Decorations must be placed so no damage results to the vessel; no pins or adhesive tape. No confetti and balloons are discouraged.
THE SKIPPER AND SUNREEF MANAGEMENT
The Skipper (Master) has total discretion as to the operation of the vessel including passenger loading, vessel route, event timing, carriage of goods, serving of alcohol, acceptable conduct of passengers, and the disembarkation of any ill-behaved guests.
In the event of a passenger being required not to embark or to disembark from the vessel under the provisions of this condition, Sunreef, nor the skipper shall be under any liability to such passenger of any kind whatsoever.
The Skipper and Sunreef shall not be responsible for any injury to person or damage to property arising out of any cruise.
Sunreef shall not be responsible for any damage or loss occasioned.
RESPONSIBLE SERVICE OF ALCOHOL
If you expect to be served alcohol we will require a valid photo ID prior to boarding. A photo image of ID is not permitted. Alcohol may not be carried from the vessel on disembarkation.
Whale One is a licensed venue and does not allow BYO. Staff reserve the right to refuse entry onto the vessel, the service/supply of alcohol to any unduly intoxicated, underage or disorderly guests.
If deemed necessary, the Skipper may elect to dock the vessel and remove the guest and notify police. Rowdy or unruly behaviour will not be tolerated. The Operator and the vessel have a “Responsible Service of Alcohol Policy” that applies during the Charter. If behaviour falls outside the guidelines of this policy then Sunreef may, in conjunction with the Skipper, do any of the following:
- Terminate the Charter by berthing the vessel at the nearest safe location and disembarking the passengers.
- Summon the Police to remove offending passengers
- Negotiate with the Charterer to agree on some other course of action to resolve the issue.
Any costs associated with the early termination of the Charter due to unruly or rowdy behaviour must be paid by the Charterer.
NOT PERMITTED
There is strictly NO SMOKING on board any of our vessels.
Passengers shall not carry any alcoholic liquor, matches (other than safety matches), explosives, volatile spirit or other goods of a dangerous, inflammable or offensive nature.
DRESS CODE
Dress appropriate for the weather; there are open air, protected and enclosed areas available, but no air conditioning. Due to safety regulations, the footwear dress code exclusions are as follows:
No thongs/flip flops
No stiletto heels
GUEST BEHAVIOUR
Good behaviour is expected. Any passengers doing the following will be reported to the Australian Maritime Safety Authority (AMSA) and/or Queensland Police Service (QPS):
- Use of illegal drugs
- Swinging from the handrails
- Jumping off the vessel
- Urinating off the side of the vessel
- Throwing debris from the vessel
- Yelling at patrons on docks and houses
- Fighting or aggressive arguments
Actions of this sort may be recorded as a Marine Incident with persons liable for on the spot or delayed fines of up to $2200.
SAFETY AND SECURITY
Our vessels are equipped to safely carry passengers. Please listen closely to the safety briefing prior to departure. If you have any questions, ask a crew member. All passengers are carried at their own risk, Sunreef does not accept responsibility or liability for any injury suffered whilst boarding, aboard, or disembarking from its vessel. Operation of the vessel and any of its equipment is restricted to the Skipper and Crew of Sunreef.
Skipper: The Skipper (Master) has total discretion as to the operation of the vessel including passenger loading, vessel route, event timing, carriage of goods, serving of alcohol, acceptable conduct of passengers, and the disembarkation of any ill-behaved guests.
Security may be on board. The vessel is monitored by CCTV. Security will enforce all listed terms and conditions and reserve the right refuse entry or to remove unruly guest from the vessel. Illegal actions will incur Queensland Police attention.
DISABILITY AND MOBILITY
Unfortunately, due to vessel construction, Sunreef vessels are not wheelchair accessible.
PRAMS
Pram space may be limited. Please advise us upon booking regarding the need for pram space.
CHARTER COURSE
The course to be undertaken during the Charter may be agreed in advance with Sunreef or with the Skipper. Sunreef reserves the right, at its sole discretion or that of the Skipper, to vary the agreed course because of weather, wave height, traffic, vessel survey restrictions, or any other cause which Sunreef or the Skipper believes is justified in the interests of the comfort or safety of passengers, crew, the vessel and other vessels.
SUBSTITUTION OF VESSEL
Sunreef may substitute another vessel for the specified vessel in the case of any unforeseen circumstances (including mechanical breakdown). In such cases, Sunreef has no liability to the Charterer for such substitution provided that the substituted vessel satisfactorily meets the Charter particulars and provides the level of services as originally agreed.
LIMIT OF LIABILITY
To the extent permissible by law, Sunreef Mooloolaba is not responsible in sort, contract or otherwise for any loss or damage arising out of injury or death sustained by the Charterer or any guest of the Charterer’s group, howsoever arising and whether arising as a result of the Operator’s negligence or failure to render due care.
The Charterer enters into this Charter Agreement at its own risk.
If, however any guarantees, terms, conditions or warranties are implied into this Charter Agreement by any law of the Commonwealth of Queensland, the exclusion of which would contravene that law or cause part or all this clause to be void, then to the extent permissible by law.
The law of Queensland governs this agreement and the parties agree to submit to the jurisdiction of the courts of Queensland in respect of any dispute arising between them. Sunreef Mooloolaba has no liability for failing to perform its obligation under this terms and conditions due to any industrial action, unsuitable weather conditions, mechanical or technical breakdowns or other events beyond its reasonable control.
The Charterer agrees to indemnity and hold Sunreef Mooloolaba harmless, it’s agents and employees from and against any and all losses, claims, actions, expenses, fees, damages, fines and liabilities (including reasonable legal fees) arising from the Charter or caused by any negligent act or omission by the Charterer or guests of the Charterer’s group.
INDEMNITY
The Charterer agrees to indemnify and hold harmless Sunreef, its agents and employees, from and against any and all losses, claims, actions, costs expenses, fees, damages, fines and liabilities (including reasonable legal fees) arising from the Charter or caused by any negligent act or omission by the Charterer or members of the Charterer’s group.
FORCE MAJURE
Sunreef has no liability for failing to perform its obligations under this terms and conditions due to any industrial action, unsuitable weather conditions, mechanical or technical breakdowns or other events beyond Sunreef’s reasonable control.
PARKING
The Wharf complex has limited timed parking before 6pm. Please allow 15-20mins prior to your boarding time to find appropriate parking.
YOUR PRIVACY
At Sunreef, we are committed to protecting your privacy. We use the information we collect about you to maximize the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adheres to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.
You may change your details at any time by advising us in writing via email. All information we receive from our customers, is protected by our secure servers. whaleone.com.au’s secure server software encrypts all customer information before it is sent to us. Furthermore, all of the customer data whaleone.com.au collects are secured against unauthorised use or access. Credit card information is not stored by us on our servers.
THIRD PARTIES
Sunreef does not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve its website and its services but not for any other use.
DISCLOSE YOUR INFORMATION
Sunreef may be required, in certain circumstances, to disclose information in good faith and where Sunreef is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
EXCLUSION OF COMPETITORS
If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of Sunreef. Sunreef expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party.
If you breach this term, then Sunreef will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. whaleone.com.au reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.
JURISDICTION
This agreement and this website are subject to the laws of Queensland and Australia. If there is a dispute between you and Sunreef that results in litigation, then you must submit to the jurisdiction of the courts of Queensland.
Please read the following points carefully.
- I understand and state that I am physically and mentally capable and trained to participate successfully in open sea condition diving. I further acknowledge that Sunreef Diving will give no refunds for seasickness, inability to equalize or for any other reason that prevents an individual from participating fully.
- I have no medical condition that would affect my ability to safely dive and I am not taking any medication that has not been approved by my physician for diving. I am not currently under the effect of alcohol or drugs.
- I will not fly within 24hrs from surfacing after my last dive.
- I warrant that as a certified diver my skill levels are at least equal to a newly certified open water diver. I understand that dive guides supplied by Sunreef are solely to enhance my diving experience and not because such guidance is required to compensate for my lack of diving skill.
- Sunreef may cancel or change trip destinations at any time due to weather or any other unforeseen circumstances.
- I will follow the direction of Sunreef staff at all times to ensure a safe and fluid operation. I will listen to all briefings and seek advice if I don't understand any part of the brief.
- I take the responsibility for checking the safe and correct operation of my dive equipment prior to diving whether the equipment be provided by myself or Sunreef Hire Gear. I will carry and know how to use the following:- safety sausage, whistle and dive computer.
- I take responsibility for the planning of my dive and then diving my plan within a safe NO DECOMPRESSION DIVE.
- By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. I am fully aware of the contents of this form and have clearly read and understood all the above points. This document is valid for 12 months from date of submission.
- By providing your email address you give permission for Sunreef to contact you in regards to diving activities and promotions.
- By filling out this form I agree to allow Sunreef Mooloolaba to use any pictures of have myself or any pictures that were taken on my trip on any social media site.
- If I am undertaking a dive on the EX-HMAS Brisbane I understand that my first dive will be an orientation dive with guide. No penetration will be allowed. Penetration dives are not to be undertaken if the sea conditions, visibility or diver ability are not seen adequate by Sunreef Employees.
Hire Terms and Conditions
- All equipment will be returned to Sunreef Diving Services – 123 Parkyn Pde, Shop 11-12 'The Wharf', Mooloolaba, QLD in a washed and clean condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent diver and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Tanks being hired are to be checked to ensure they have a fill pressure of at least 200 Bar.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable, including unused air.
- Please note that no refund will be issued for any dives not completed.
Please read the following very carefully:
- At all times you must stay within the designated hire area (Mooloolah River and Canals only)
- If you are over the age of 12 and are able to swim you are not required to wear a lifejacket. However, lifejackets are issued free of charge to any participant and if required must be worn at all times.
- 0 (Zero) alcohol tolerance level is required of all participants.
- You MUST report any incident or collision that has occurred during your hire.
- You are responsible for any participants under 18 years of age
- Only people named by you on this form are allowed to use the hired equipment
- You must wear the leg strap at all times
- You are required to leave and return to the pontoon in the kneeling position (within 10 meters)
- You are deemed responsible for your own safety and the safety of others, as such, you participate at your own risk and you will be held responsible for injury caused wilfully or by negligence on your part.
- You are deemed responsible for the care of the equipment you hire, as such, you are accountable for any damage and understand further costs can be bought against you
- You acknowledge that you are solely responsible for obtaining all advice and information necessary for the safety and the safe use of the stand-up paddle equipment.
- The owners, management and staff of Hire Hut Mooloolaba reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.
I ACKNOWLEDGE AND UNDERSTAND THAT WHILST PARTICIPATING IN THE ACTIVITY:
- The conditions in which the activity is conducted may vary without warning.
- Other persons participating in the activity may cause me injury or damage to my property for which they may be liable.
- I may cause injury to other persons or damage their property, for which I may be liable.
- I may cause loss of damage to property used/hired for which I would be liable.
- I may be injured/ inflict damage to my property as a result of my negligence or breach of contract.
- There may be no or inadequate facilities for treatment or transport of me if I am injured.
- I assume the risk of and responsibility for any injury, death or property damage resulting from my participation.
- I will take special attention to all instructions oral or written and will query any matters that I do not understand.
- I am not under the influence of drugs/medication/mind altering substances that affect my understanding of safety instructions or ability to safely participate.
- I do not have any allergies that affect my ability to participate any aspect of this activity
- I do not suffer from any mental infirmity/allergies that may prejudice my performance/safety or the safety of others.
- I name and acknowledge the full responsibility for participants less than 16 years of age.
Release and indemnity to the service provider:
In consideration of the acceptance of me participating, except to the extent it is precluded by statutory law I AGREE TO RELEASE AND INDEMNIFY the service provider as follows:
I release, indemnify and hold harmless the service provider, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever.
Please read the following points carefully.
- I am aware that snorkelling has inherent risks which may result in serious injury or death.
- I am aware that this tour is 100% on the whales terms and there is no guarentee on the swimming portion of it. Sunreef will do everything in its power to get you an inwater experience with the whale.
- I am aware that I will be swimming in open ocean conditions and am physically able to do this.
- Touching the whales is strictly prohibited.
- There is to be no duck diving, weight belts or flash photography.
- Sunreef may cancel or change trip destinations at any time due to weather or any other unforeseen circumstances.
- Sunreef may change the time of my trip due to weather or any other unforeseen circumstances.
- If you wish to change your booking in any way, it must be done at least 72hrs prior to the planned start time of your trip. Changes made within the 72hrs will incur a charge of $195. I will follow the direction of Sunreef staff at all times to ensure a safe and fluid operation. I will listen to all briefings and seek advice if I don't understand any part of the brief.
- I understand and agree that neither my guide(s)/instructor(s), nor the facility through which this program is offered, Sunreef, nor PADI Americas, Inc., nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”), may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this program or as a result of the negligence of any party, including the Released Parties, whether passive or active.
- In consideration of being allowed to participate in this program, I hereby personally assume all risks of this program whether foreseen or unforeseen, that may befall me while I am participating in this program. I further release, exempt and hold harmless said program and Released Parties from any claim or lawsuit by me, my family, estate, heirs or assigns, arising out of my enrollment and participation in this program.
- I understand that snorkeling and skin diving are physically strenuous activities and that I will be exerting myself during this program, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same.
- I understand that past or present medical conditions may be contraindicative to my participation in the program. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have or have informed Sunreef of a history of seizures, dizziness or fainting, or a history of heart condition (e.g. cardiovascular disease, angina, heart attack). I further affirm that I do not have or have informed Sunreef of a history of respiratory problems such as emphysema or tuberculosis. I affirm that I am not, or I have informed Sunreef that I am, currently taking medication that carries a warning about any impairment of my physical or mental abilities.
- I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian.
- I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. I, AGREE TO EXEMPT and RELEASE MY GUIDE(S)/INSTRUCTOR(S), THE FACILITY THROUGH WHICH I RECEIVE MY INSTRUCTION, SUNREEF, AND PADI AMERICAS, INC., AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS NON-AGENCY DISCLOSURE AND ACKNOWLDGEMENT AGREEMENT AND LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BOTH BEFORE SIGNING BELOW ON BEHALF OF MYSELF AND MY HEIRS.

- I understand that both dives on the selected reef site will be guided. Dives into overhead environments are not to be undertaken if the sea conditions, visibility or diver ability are not seen adequate by Sunreef Employees.
- The dives are planned as 50 minute Dives.
- I will return to the vessel with a minimum of 50bar remaining in my cylinder, failure to do so may result in cancellation of my second dive or refusal for future bookings.
By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. I am fully aware of the contents of this form and have clearly read and understood all the above points. This document is valid for 12 months from date of submission. Hire Terms and Conditions

- By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. - I understand and agree that neither my guide(s)/instructor(s), nor the facility through which this program is offered, Sunreef, nor PADI Americas, Inc., nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”), may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this program or as a result of the negligence of any party, including the Released Parties, whether passive or active.
- In consideration of being allowed to participate in this program, I hereby personally assume all risks of this program whether foreseen or unforeseen, that may befall me while I am participating in this program. I further release, exempt and hold harmless said program and Released Parties from any claim or lawsuit by me, my family, estate, heirs or assigns, arising out of my enrollment and participation in this program.
- I understand that snorkeling and skin diving are physically strenuous activities and that I will be exerting myself during this program, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same.
- I understand that past or present medical conditions may be contraindicative to my participation in the program. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have or have informed Sunreef of a history of seizures, dizziness or fainting, or a history of heart condition (e.g. cardiovascular disease, angina, heart attack). I further affirm that I do not have or have informed Sunreef of a history of respiratory problems such as emphysema or tuberculosis. I affirm that I am not, or I have informed Sunreef that I am, currently taking medication that carries a warning about any impairment of my physical or mental abilities.
- I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian.
- I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. - I take responsibility for the planning of my dive and then diving my plan within a safe NO DECOMPRESSION DIVE.
- I understand that both dives on the selected reef site will be guided. Dives into overhead environments are not to be undertaken if the sea conditions, visibility or diver ability are not seen adequate by Sunreef Employees.
- The dives are planned as 50 minute Dives.
- I will return to the vessel with a minimum of 50bar remaining in my cylinder, failure to do so may result in cancellation of my second dive or refusal for future bookings.
By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. - Cancellation or transfer of course starting dates within 7 days of the nominated start date will result in loss of $330 deposit or if you wish to change your booking to another date with in 72hrs of the start date there will be a $165 transfer fee.

- If any of the medical questions on the forms below are answered 'yes' a valid dive medical is required. If this cannot be produced on the first day of the course the above cancellation policies apply.

- This course is run over 2 days and 2 boat trips- 3 dives on the first day and 2 dives on the second day. If additional days are needed for any reason, fees will be applied at full retail rates.
- From the first day of your course you have 1 year to complete the course. If you take longer than 1 year to complete the practical components of the course you will be required to pay an additional fee at the discretion of Sunreef Management to complete a diver skills assessment in the pool before being able to complete your open water dives.
- This course requires additional equipment to the standard hire gear. You will need an Advanced Open Water dive slate which is included in the course, an underwater writing slate which can be purchased in the shop, as well as any other equipment necessary for the elected Adventure dives that you choose. If you do not have the required equipment on the day, you will need to purchase it from the dive shop to proceed with the course.
- If you choose a Night dive as one of your elected Adventure dives, you will need to pay an additional $99 as it is run as a separate trip.
- Your PADI eLearning which is a requirement of the course is to be completed before attending your first day of your course. This expires after exactly 12 months from the day you redeemed your code. This can not be extended.

- I take the responsibility for checking the safe and correct operation of my Free Dive equipment prior to diving, whether the equipment is provided by myself or Sunreef's hire gear.

- All equipment will be returned to Sunreef Mooloolaba – 123 Parkyn Pde Shop 11-12 'The Wharf', Mooloolaba, Qld, 4557 in a washed and clean condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent snorkeller and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable.
- Please note that no refund will be issued for any dives or activities not completed.

- Cancellation or transfer of course starting dates within 7 days of the nominated start date will result in loss of $330 deposit or if you wish to change your booking to another date there will be a $99 transfer fee.

- At all times you must stay within the designated hire area (Mooloolah River and Canals only)
- If you are over the age of 12 and are able to swim you are not required to wear a lifejacket. However, lifejackets are issued free of charge to any participant and if required must be worn at all times.
- 0 (Zero) alcohol tolerance level is required of all participants.
- You MUST report any incident or collision that has occurred during your hire.
- You are responsible for any participants under 18 years of age
- Only people named by you on this form are allowed to use the hired equipment
- You must pay for any broken or lost paddles/ seats or kayaks
- You are deemed responsible for your own safety and the safety of others, as such, you participate at your own risk and you will be held responsible for injury caused wilfully or by negligence on your part.
- You are deemed responsible for the care of the equipment you hire, as such, you are accountable for any damage and understand further costs can be bought against you
- You acknowledge that you are solely responsible for obtaining all advice and information necessary for the safety and the safe use of the stand-up paddle equipment.
- The owners, management and staff of Hire Hut Mooloolaba reserves the right to refuse, cancel or stop any hire at any time without a refund if a person does not adhere to these rules or is negligent, remiss, not confident or a potential danger to themselves or other persons or property.
I ACKNOWLEDGE AND UNDERSTAND THAT WHILST PARTICIPATING IN THE ACTIVITY:
- The conditions in which the activity is conducted may vary without warning.
- Other persons participating in the activity may cause me injury or damage to my property for which they may be liable.
- I may cause injury to other persons or damage their property, for which I may be liable.
- I may cause loss of damage to property used/hired for which I would be liable.
- I may be injured/ inflict damage to my property as a result of my negligence or breach of contract.
- There may be no or inadequate facilities for treatment or transport of me if I am injured.
- I assume the risk of and responsibility for any injury, death or property damage resulting from my participation.
- I will take special attention to all instructions oral or written and will query any matters that I do not understand.
- I am not under the influence of drugs/medication/mind altering substances that affect my understanding of safety instructions or ability to safely participate.

- By providing your email address you give permission for Sunreef to contact you in regards to diving activities and promotions.
- By filling out this form I agree to allow Sunreef Mooloolaba to use any pictures of have myself or any pictures that were taken on my trip on any social media site.
- If I am undertaking a dive on the EX-HMAS Brisbane I understand that my first dive will be an orientation dive with guide. No penetration will be allowed. Penetration dives are not to be undertaken if the sea conditions, visibility or diver ability are not seen adequate by Sunreef Employees.
Hire Terms and Conditions
- All equipment will be returned to Sunreef Diving Services – 123 Parkyn Pde, Shop 11-12 'The Wharf', Mooloolaba, QLD in a washed and clean condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent diver and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Tanks being hired are to be checked to ensure they have a fill pressure of at least 200 Bar.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable, including unused air.
- Please note that no refund will be issued for any dives not completed.
Course and Trip Booking Cancellation Policies
- Cancellation or transfer of course starting dates within 21 days of the nominated start date will result in loss of $330 deposit.
- Final payment is due on the first day of the course upon arrival this fee is non- refundable
- If any of the medical questions are answered 'yes' a valid 4005.1 AS Dive Medial is required, if this cannot be produced on the first day of the course the above cancellation policies apply.
- Failure to turn up for any portion of the course at the time stipulated by Sunreef Employees a additional fee will be charged
- If any dives are missed for any reason and additional charter fee is applicable at the discretion of Sunreef Management. This includes but is not limited to seasickness and equalization issues.

I am aware that skin diving has inherent risks which may result in serious injury or death. I understand and agree that neither my guide(s)/instructor(s), nor the facility through which this program is offered, Sunreef, nor PADI Americas, Inc., nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”), may be held liable or responsible in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this program or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to participate in this program, I hereby personally assume all risks of this program whether foreseen or unforeseen, that may befall me while I am participating in this program. I understand that past or present medical conditions may be contraindicative to my participation in the program. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have a history of seizures, dizziness or fainting, or a history of heart condition (e.g. cardiovascular disease, angina, heart attack). I further affirm that I do not have a history of respiratory problems such as emphysema or tuberculosis. I affirm that I am not currently taking medication that carries a warning about any impairment of my physical or mental abilities. I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. - I understand that this experience is purely a surface activity and that while undertaking this activity I will not duck dive below the surface for any reason, repeated occurrences of this may result in my expulsion from the water and no refund will be available for this eventuality

It is expressly understood and agreed between the parties that:
- The lessee (You) agrees to pay for all damage to the bicycle(s) and or equipment during the hire period and agrees to pay all repair or replacement cost.
- The lessee agrees that they are fully responsible for all losses if the bicycles(s) and or equipment is/ are lost, stolen or destroyed. In the event of such occurrences charges are set at the time by any staff or management of Sunreef Mooloolaba.
- I name and acknowledge the full responsibility for participants less than 18 years of age
- If applicable upon returning the hired equipment if staff or management of Sunreef Mooloolaba deem fit an additional cleaning fee of $25 may be charged or an additional cleaning fee of $95 is applicable if ridden on the beach or if there are signs of the bicycle(s) being ridden on the beach.
- When leaving the bicycle unattended it must be secured with the lock provided through the frame of the bike to an immovable object. In the event of the lessor (Sunreef Mooloolaba) being called out due to key loss a $35 fee will be charged.
- If the lessee loses the lock a fee of $25 is applicable
- All riders must wear an approved helmet which is provided by the lessor or their own approved helmet.
- The lessee must inspect the bicycle and associated equipment prior to the completion of the rental agreement, the lessee confirms that the bicycle(s) is in a good roadworthy condition and has no damage or defects whatsoever.
- Night cycling is not permitted as the bicycles are not fitted with lights.
- Bikes not returned at the specified time will be charged an extra hour rental charge.
- The lessee agrees that the bicycle(s) will not be ridden by anyone except for the people named in the form.
- The lessee agrees that participant(s) will comply with all road rules at all times.
- The lessee will notify Sunreef Mooloolaba immediately of any accident or damage.
- The lessee acknowledges that renting a bicycle entails unknown risks that could result in injury or damage to participants, property or third parties and the lessee accepts that such risks cannot be eliminated without jeopardizing the essential qualities of the activities. The risks include among other things: accidents involving other vehicles or bicycles, collision with fixed or moveable objects, falls from the bicycle, the negligence of other operators of motor vehicles or the participant, weather conditions, the participants own physical conditions, the condition of roads, terrain or highways and accidents connected with their use, contact with animals or insects.
- The lessee hereby releases and forever discharges and indemnifies and agrees to indemnify and hold harmless Sunreef Mooloolaba, their agents, owners, officers, volunteers, participants and employees against any and all claims, demands and causes of action which are in any way connected with participation in this activity or use of Sunreef Mooloolaba equipment or facilities. Such release may be pleaded as a complete defence to any claim, demand or cause of action brought by the lessee, a participant or anyone claiming through the lessee against Sunreef Mooloolaba.
- Any breach of this agreement by the lessee and or participant(s) gives Sunreef Mooloolaba the right to terminate this agreement and to immediately repossess the bicycle(s) and accessories.
Road Rules
- As a bicycle rider you are riding a ‘legal’ vehicle. You have the same rights and responsibilities as any other vehicle on the road. As such you are required to obey the road rules, including stopping at red lights or stop signs, giving way as indicated by signage and giving hand signals when changing direction.
- Key Road rules that apply to cyclists include but are not limited to:
- All cyclists are required by law to wear an approved helmet. The Police will fine cyclists who ride without an approved helmet
- Cyclists can ride in bus, transit and bicycle lanes.
- In Queensland cyclists can ride on footpaths unless prohibited by a sign, but must keep left and give way to pedestrians.
- Cyclists can ride 2 abreast, but must remain within 1.5m of each other
- While riding on roads, cyclist are required to use bike lanes where provided unless impractical to do so
- You must obey all traffic lights

I understand that snorkeling and skin diving are physically strenuous activities and that I will be exerting myself during this program, and that if I am injured as a result of heart attack, panic, hyperventilation, drowning or any other cause, that I expressly assume the risk of said injuries and that I will not hold the Released Parties responsible for the same. I understand that past or present medical conditions may be contraindicative to my participation in the program. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have a history of seizures, dizziness or fainting, or a history of heart condition (e.g. cardiovascular disease, angina, heart attack). I further affirm that I do not have a history of respiratory problems such as emphysema or tuberculosis. I affirm that I am not currently taking medication that carries a warning about any impairment of my physical or mental abilities. I further state that I am of lawful age and legally competent to sign this liability release, or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not a mere recital, and that I have signed this Agreement of my own free act and with the knowledge that I hereby agree to waive my legal rights. I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision shall be severed from this Agreement. I further represent I have the authority to do so and that my heirs, assigns, or beneficiaries will be estopped from claiming otherwise because of my representations to the Released Parties. I, AGREE TO EXEMPT and RELEASE MY GUIDE(S)/INSTRUCTOR(S), THE FACILITY THROUGH WHICH I RECEIVE MY INSTRUCTION, SUNREEF, AND PADI AMERICAS, INC., AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF AND MY HEIRS OF THE CONTENTS OF THIS NON-AGENCY DISCLOSURE AND ACKNOWLDGEMENT AGREEMENT AND LIABILITY RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING BOTH BEFORE SIGNING BELOW ON BEHALF OF MYSELF AND MY HEIRS.
PLEASE READ THE FOLLOWING POINTS CAREFULLY:
- I understand and state that I am physically and mentally capable and trained to participate successfully in open sea condition snorkelling. I further acknowledge that Sunreef will give no refunds for seasickness, or for any other reason that prevents an individual from participating fully.
- I have no medical condition that would affect my ability to safely Snorkel and I am not taking any medication that has not been approved by my physician for snorkelling. I am not currently under the effect of alcohol or drugs.
- Sunreef may cancel or change trip destinations at any time due to weather or any other unforeseen circumstances.
- I will follow the direction of Sunreef staff at all times to ensure a safe and fluid operation. I will listen to all briefings and seek advise Sunreef staff if I do not understand any part of the brief.
- I take the responsibility for checking the safe and correct operation of my Snorkel equipment prior to diving, whether the equipment is provided by myself or Sunreef's hire gear.
- By acknowledging this, I agree to release Sunreef, its employees/contractors or associated agents from being sued for personal injury, wrongful death or damage to personal equipment. I am fully aware of the contents of this form and have clearly read and understood all the above points. This document is valid for 12 months from date of submission.
- I understand that this experience is purely a surface activity and that while undertaking this activity I will not duck dive below the surface for any reason, repeated occurrences of this may result in my expulsion from the water and no refund will be available for this eventuality
Hire Terms and Conditions
- All equipment will be returned to Sunreef Mooloolaba – 123 Parkyn Pde Shop 11-12 'The Wharf', Mooloolaba, Qld, 4557 in a washed and clean condition as it was in upon delivery to the hirer at the commencement of hiring.
- If the equipment is returned after the return date, it will be charged for until return, on a daily basis at the regular rates charged by the company.
- If any equipment is returned in a damaged state or lost, the same shall be replaced or repaired at Sunreef Diving’s sole discretion. Whenever repairs or replacement is required the amount charged shall be the replacement cost of the Unit at Retail Cost or repair cost.
- It is understood that the Hirer is a competent snorkeller and that no claim whatsoever can be forthcoming from the use of the above equipment.
- All equipment is to be inspected by the Hirer prior to leaving the dive centre for correct function and serviceability.
- Once equipment leaves the Dive Centre it is considered hired and no refunds are applicable.
- Please note that no refund will be issued for any dives or activities not completed.
