Out Of The Blue cruises are run under the authority of a qualified Captain.
- I agree to follow all laws, rules and directions from the OUT OF THE BLUE Captain and staff.
- I understand and agree that the decision of the Captain is final on all matters likely to affect the safety or wellbeing of any traveller or staff member participating on the cruise. If any passenger fails to comply with a decision made by the Captain, or interfere with the wellbeing of other passengers, or should a passenger fall seriously ill, the Captain may decide to cancel the cruise and return to the wharf. If the situation warrants, the Captain will contact the appropriate authorities to meet the boat on its return.
- I understand that OUT OF THE BLUE reserves the right to refuse any passenger if OUT OF THE BLUE staff believe the passenger will compromise the safety of others or is displaying signs of intoxication or drug use and will not issue a refund in this instance.

Out Of The Blue Adventures Pty Ltd staff have warned me that if I travel in a vessel such as OUT OF THE BLUE (“the boat”) I may experience physical and psychological stress due to the ability of the boat to travel at high speeds in rough conditions.
- I understand and accept that the nature of the cruise is adventurous, and participation involves a degree of personal risk. You will be cruising on the open ocean and this may present dangers and physical challenges greater than those present in our daily lives. Out Of The Blue use information from government and commercial weather forecasts and reports from our own contacts in assessing whether a cruise should operate.
- I acknowledge that my decision to travel is made in light of consideration of this information and I accept that I am aware of the personal risks attendant upon such activity.
- I understand that Out Of The Blue will not be held liable for the safety, loss or damage of personal valuables while participating in OUT OF THE BLUE experiences.
- I understand that OUT OF THE BLUE operate in a marine environment, and passengers can get wet or be exposed to conditions that they do not necessarily experience on land.
- I understand and agree that my experience with OUT OF THE BLUE is undertaken entirely at my own risk.
- I have been warned that due to the movement of the boat at high speed in rough conditions, I could suffer from; Motion sickness and/or Strain or injury to my knees, arms and back and/or Stress that could affect me adversely if I have a heart condition.
- I have been advised that I SHOULD NOT travel in the boat if;
- I am suffering from any kind of back injury
- I am prone to sea sickness or motion sickness
- I have a heart condition
- I have any knee injury or disability
- I have any injury or disability affecting my ability to grip handrails and safety supports
- I am pregnant
- I have had any major surgery in the past 6 months
The customer agrees and acknowledges that, to the extent permitted by law, the Proprietor (Out of The Blue Adventures Pty Ltd), its directors, employees, captain, agents, affiliates or partners will not be held liable for any accident, injury, loss or damage to any person or property however caused whilst embarking, traveling on or disembarking from OUT OF THE BLUE vessels, whether such injury or loss was caused directly or indirectly by the negligence of the Proprietor/Captain or by the Proprietors servants or agents. The customer hereby releases the Proprietor/Captain from all such claims, and indemnifies the Proprietor against all such claims made by or on behalf of any other person.
Seating
I understand that no seating configuration is guaranteed, although OUT OF THE BLUE staff will do their best to accommodate the particular requirements and needs of their passengers. Our seating is determined by conditions, age of passengers and group sizes so it will vary on each cruise session.
Photos and Marketing
I consent to Out Of The Blue using images of the experience, which may include me in them for advertising and promotional purposes in any medium Out Of The Blue may choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.
Customer Satisfaction
I understand that it is my responsibility to inform the captain or Out Of The Blue staff if I have an issue or complaint about my cruise experience at the time, in order for them to attempt to rectify the matter immediately.
Cancellation & Time Changes
I understand that Out Of The Blue reserves the right to cancel, change or adapt any tour it sees fit at any time allowing for weather, ocean conditions, safety, equipment concerns or minimum passenger requirement not met. In such a case, OUT OF THE BLUE will try to reschedule the trip if possible.
I understand that OUT OF THE BLUE will not be held liable for any loss or expense incurred by the passenger caused by such cancelation, change or adaptation. In the case of extreme weather conditions please contact Out Of The Blue the day before to confirm any possible cancelations.
I understand that If the cruise departs and ocean and weather conditions change to be unsuitable, the vessel will return to the wharf and you will have the option to reschedule to another day.
Cruise time change can be made at any time or cancellation of cruise up until time of departure and at the wharf.
